Act on employees' inventions |
| |
|
According to general estimations about 80 to 90% of all the patent applications
filed in Germany arise from inventions made by company staff, which are
known as employees' inventions. While from a Labour Law point of view
the results of development work are the property of the employer, patent
law initially assigns the ownership of the invention exclusively to the
employee. The act on employees' inventions provides a solution to this
conflict and, with proper application, can also serve as an encouragement
to open up new markets with the help of inventions.
