High quality designs are gaining increasing importance as marketing instruments.
The manufacturers of consumer goods, household equipment, furniture or
lights, but also of motor cars and clothing, are paying ever greater attention
to the little details of appearance - and are using such features to distinguish
themselves from their competitors. An industrial design is a form of industrial
property right that is conceived to protect the shape and surface design
of a product. At the time the application is filed the design must be
new and distinctive. The registration of a German industrial design is
made at the German Patent and Trade Mark Office and protection is currently
given for a maximum of 20 years. The registration of a Community design,
which is effective within the European Union, is made at the Office for
Harmonisation in the Internal Market (OHIM) and protection is given for
a maximum of 25 years .
